Terms of Service

These terms are between you (the business that keeps a website) and Caribeam Inc., trading as Kohmera (“we”, “us”). By subscribing you agree to them.

1. What we provide

We build a website for your business and show it to you as a private preview before you pay anything. When you subscribe, we launch the site on your own web address, host it, keep it secure and keep it online for as long as your subscription is active.

2. What the plan includes

The Kohmera plan includes the website, hosting, a security certificate, saved copies of every version, a site that works on phones, connecting your own web address (see the Web address terms), setup for search engines and AI assistants, visitor numbers, and up to 2 routine change requests per month. Unused change requests do not carry over to the next month.

A routine change is a small update to an existing site: hours, prices, photos you provide, wording, a new service, a new team member, a new page in the existing design. Work that amounts to a new project, such as an online store, a booking system that takes payment, a blog, a redesign or a second website, is not a routine change.

Add-ons are not included in the plan. Each one has the monthly price listed on the Price page when you choose it (Book online, 24/7: $19; Quote requests with photos: $9; Deposits when they book: $15; A page for every town you serve: $19; Your site in French or Spanish: $19; Google Maps profile, done for you: $29; More Google reviews, less asking: $19; Bring past customers back: $29), is added to your subscription only when you choose it, and can be dropped at the end of any month. Work that is not on that list, such as an online store, is priced first and nothing starts until you agree.

3. Price and billing

The price is $49 US dollars per month, or $49 Canadian dollars per month for businesses in Canada. The currency is shown on your claim page and on your receipt. Subscriptions renew each month. Payment is handled by Stripe; we do not store card numbers. Prices can change with 30 days’ notice by email, and a change never applies before your next renewal. There is no build fee and no set-up fee.

4. Cancelling

You can cancel at any time by replying to any of our emails or from the link on your receipt. Your site stays online until the end of the period you have paid for, then comes down. There are no cancellation fees. Payments already made are not refunded except where the law requires it.

5. Your content and ownership

The words, photos and facts on your site come from information you or your business made public, or that you send us. You own that content and you confirm you have the right to use it. Your web address stays yours (see the Web address terms). We own the code, layout and design of the site while you are a subscriber; the site’s files are not included when you leave. If you want a copy to host elsewhere, you can buy one; ask us for the price.

6. Changes

Send changes by replying to any of our emails or by writing to hello@kohmera.com. We confirm what we understood, make the change and tell you when it is live. Changes beyond what your plan includes are quoted first.

7. What we do not do

Email hosting is not included. We do not guarantee search engine rankings, a position in AI assistants’ answers, or a number of customers or leads. We build and maintain the site using current technical search and AI-discovery practices, and that is what we promise.

8. Uptime and outages

We host on Cloudflare’s network and aim for the site to be available at all times. Outages outside our control (Cloudflare, your domain registrar, the internet) are not something we can refund.

9. Portfolio

We may show your live site in our portfolio with its name and a screenshot. Reply “no portfolio” to any email and we will remove it within 7 days.

10. Ending the agreement

We may end the agreement with 30 days’ notice, or immediately if your site is used for something covered by the Acceptable use policy. Your web address always stays yours.

11. Liability

Our total liability for anything arising from this agreement is limited to the fees you paid us in the 12 months before the claim. We are not liable for lost profits or indirect losses. Nothing here limits liability that cannot be limited by law.

12. Law

These terms are governed by the laws of the Province of Ontario and the laws of Canada that apply there. Disputes go to the courts of Ontario.
